Disclosure Gaps in Nighttime Advocacy

1. Scope and Attribution

This brief was prepared by the Office of Nighttime Opposition Research under Director Raymond Hollis and reflects the investigative standards of that office: only what can be observed is reported, and only what can be documented is concluded. The reader should weigh at the outset a structural fact this office confronts daily, which is that the subject of this investigation is most active precisely when observation is hardest. The Foundation does not allege that this is deliberate. The Foundation reports that it is convenient, and lets the record carry the rest.

2. Funding

A search of public lobbying disclosures at the federal level and in all 50 states identified no filings by the nighttime lobby in any jurisdiction. No registered agents. No disclosed donors. No reported expenditures. An entity of its evident reach has therefore reported, in aggregate, nothing, and this office has learned that disclosing nothing on this scale is not an accident of paperwork but a sustained achievement. For comparison, the Solar Save Foundation’s complete funding disclosure is a matter of public record and required very little time to prepare, because we practice the transparency this brief was forced to go looking for.

3. Meeting Practices

Every known convening of nighttime interests occurs after dark. Investigators from this office made three attempts to observe such proceedings during the reporting period, and on each occasion visibility had already deteriorated in a manner consistent with the subject’s preferences. No meeting of the nighttime lobby has ever been scheduled during daylight hours, a pattern that has held across every night this office has monitored, which is all of them. Big Dark, the umbrella under which these interests are believed to coordinate, did not respond to written questions, and the questions were submitted well before sunset to remove any scheduling excuse.

4. Alignment with Lunar Interests

The alignment between the nighttime lobby and lunar interests is documented in this brief by the following observation: both prefer night. This office is aware that a single point of alignment may appear circumstantial, and notes in response that the correlation has held on every night studied, without exception, for the full duration of the investigation and, per the astronomical literature, considerably longer. The Moon was afforded an opportunity to comment through the Foundation’s standard outreach channels and produced nothing, an output consistent with its record in illumination. The Moon has never disclosed the source of the light it presents at night, and this office confirmed through independent review that the source is the Sun, uncredited.

6. Assessment

This office is careful with its conclusions and will remain so here. The evidence assembled above is circumstantial, and the office notes that circumstances are precisely what an entity operating exclusively at night would prefer the record to consist of. No law currently requires the nighttime lobby to disclose its funding, its membership, or its meetings, and this brief takes no position on why the law developed that way, beyond observing who benefits each evening from the gap.

7. Recommendations

1. Continued nightly observation, which this office has performed without interruption and will sustain for as long as night persists, an assumption we revisit each morning with relief.
2. Adoption of disclosure standards for after dark advocacy equivalent to those met voluntarily by daylight organizations, of which the Foundation remains the leading example.
3. A subsequent brief. The investigation remains open, the file remains active, and the Office of Nighttime Opposition Research remains at its post, facing the dark, documenting it.
